{"id":16442,"date":"2022-11-01T23:31:01","date_gmt":"2022-11-02T03:31:01","guid":{"rendered":"https:\/\/d3.harvard.edu\/platform-digit\/?post_type=hck-submission&#038;p=16442"},"modified":"2022-11-02T00:26:37","modified_gmt":"2022-11-02T04:26:37","slug":"protonmail-apple-and-the-battle-to-build-a-privacy-ecosystem","status":"publish","type":"hck-submission","link":"https:\/\/d3.harvard.edu\/platform-digit\/submission\/protonmail-apple-and-the-battle-to-build-a-privacy-ecosystem\/","title":{"rendered":"ProtonMail, Apple, and the Battle to Build a \u201cPrivacy Ecosystem\u201d"},"content":{"rendered":"\n\n\n<p>In early 2018, ProtonMail CEO Andy Yen received an ominous email from Apple\u2019s App Store compliance team. It warned Yen that his company\u2019s encrypted email service app was in breach of Apple\u2019s rules and that it would have to add \u201cIn App Purchases\u201d (IAPs) in order to remain on the App Store. <a href=\"https:\/\/www.macrumors.com\/2020\/10\/08\/apple-in-app-purchases-protonmail\/\">For the last 2 years<\/a>, ProtonMail had offered a premium paid email service through its web app, though it did not offer any of the paid service functionalities in its iPhone app. But Apple had stumbled upon a notice in the ProtonMail app that advertised ProtonMail\u2019s paid web app service, which it argued breached <a href=\"https:\/\/www.axios.com\/2022\/10\/27\/apple-app-store-meta-spotify\">Apple\u2019s policies<\/a> mandating that \u201cthe sale of digital goods and services within an app must use In-App Purchase.&#8221; Rather than fight, Yen decided to immediately comply. <a href=\"https:\/\/www.macrumors.com\/2020\/10\/08\/apple-in-app-purchases-protonmail\/\">Said Yen<\/a>: \u201cThey are judge, jury, and executioner on their platform, and you can take it or leave it\u2026 There\u2019s nothing you can say to that.\u201d<\/p>\n\n\n\n<p><strong>Building a Privacy Ecosystem<\/strong><\/p>\n\n\n\n<p>ProtonMail began as an invitation-only public beta in 2014, <a href=\"https:\/\/proton.me\/blog\/protonmail-raises-a-record-500000-through-crowdfunding-to-disrupt-the-state-of-email-communications\">raising over $500,000<\/a> through a crowdfunding campaign on Indiegogo. In 2016, the company <a href=\"https:\/\/qz.com\/why-proton-is-lobbying-against-apple-and-google-s-app-s-1849348459\">moved<\/a> to a freemium business model. The company had since launched Proton Calendar, Proton Drive (file sharing and cloud storage) and Proton VPN. While each of these services could be accessed for free, there were various limitations for non-paying users (e.g., only 1GB storage and 150 emails per day for ProtonMail). Yen\u2019s vision for ProtonMail was to create an entire \u201cprivacy ecosystem\u201d of services to rival the dominant players: Google, Apple and Facebook. <a href=\"https:\/\/qz.com\/why-proton-is-lobbying-against-apple-and-google-s-app-s-1849348459\">For Yen<\/a>, &#8220;[t]he idea that to have an online existence, you have to sell your most intimate and sensitive and private information to tech giants, is fundamentally wrong and also morally incorrect.\u201d <\/p>\n\n\n\t\t<div class=\"embed-wrapper\">\n\t\t\t<figure class=\"wp-block-embed wp-embed-aspect-16-9 wp-has-aspect-ratio\"> \n\t\t\t\t<div\n\t\t\t\t\tclass=\"rkv-video-placeholder \"\n\t\t\t\t\tstyle=\"background-image:url(https:\/\/img.youtube.com\/vi\/La-51F9d69w\/hqdefault.jpg);aspect-ratio:16 \/ 9\"\n\t\t\t\t\tdata-provider=\"youtube\"\n\t\t\t\t\tdata-video-id=\"La-51F9d69w\"\n\t\t\t\t><\/div>\n\t\t\t<\/figure>\n\t\n\t\t\t\t\t<\/div>\n\t\t\n\n\n<p>To <a href=\"https:\/\/qz.com\/why-proton-is-lobbying-against-apple-and-google-s-app-s-1849348459\">its supporters<\/a>, ProtonMail had not only found a way to make \u201cprivacy profitable,\u201d it had done so in a way that was more scalable than \u201calternative models because [ProtonMail has not taken] the yearly fundraising that a lot of other companies do to scale.\u201d By 2022, the company based 70 million accounts and 400 employees. With the exception of a $2m in financing from a nonprofit foundation and Charles River Ventures in 2015, the company <a href=\"https:\/\/qz.com\/why-proton-is-lobbying-against-apple-and-google-s-app-s-1849348459\">had not received any other venture capital funding <\/a>over the last 6 years and neither investor was still involved in the company.<\/p>\n\n\n\n<p><strong>Apple Steps In<\/strong><\/p>\n\n\n\n<p>Following Apple\u2019s 2018 demand for ProtonMail to add IAPs, the company had to give Apple a 30% commission of each subscription through the App Store. To account for the commission, however, <a href=\"https:\/\/www.nytimes.com\/2020\/07\/28\/technology\/apple-app-store-airbnb-classpass.html\">ProtonMail began charging customers 30% higher fees<\/a> for subscription\u2019s purchased through the ProtonMail iPhone app as opposed to subscriptions purchased on its website. <a href=\"https:\/\/www.nytimes.com\/2020\/07\/28\/technology\/apple-app-store-airbnb-classpass.html\">Apple then warned<\/a> the company to harmonize its pricing or risk having the app de-platformed. Then, when ProtonMail&#8217;s app was updated to notify its users that 30% of the subscription price went to Apple, \u201c<a href=\"https:\/\/www.theverge.com\/2020\/10\/8\/21506995\/apple-forced-in-app-purchase-protonmail-ceo-wordpress-iap\">Apple threatened to remove<\/a> the app and blocked all updates.\u201d&nbsp;<\/p>\n\n\n\n<p>In September 2020, Apple appeared to have buckled under increasing public pressure and regulatory scrutiny when it amended its <a href=\"https:\/\/developer.apple.com\/app-store\/review\/guidelines\/\">App Store policies<\/a> to exempt \u201cfree apps acting as a standalone companion to a paid web-based tool,\u201d including \u201cemail services,\u201d from the in-app purchase requirement.  In theory, the App Store policy changes meant that ProtonMail could eliminate In-App Purchases from its iPhone app and allow all users to subscribe through its website, at a lower price. Yet, <a href=\"https:\/\/www.nytimes.com\/2020\/07\/28\/technology\/apple-app-store-airbnb-classpass.html\">ProtonMail had not adjusted its policies<\/a> because it remained fearful that Apple\u2019s rules still prevented it from communicating with users about the policy change. Indeed, up to the time of writing this piece, the <a href=\"https:\/\/developer.apple.com\/app-store\/review\/guidelines\/\">App Store guidelines<\/a> prevented app developers from \u201ccalls to action for purchase outside the app.\u201d&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><a href=\"https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1-1024x723.jpg\" alt=\"\" class=\"wp-image-16456\" width=\"779\" height=\"550\" srcset=\"https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1-1024x723.jpg 1024w, https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1-300x212.jpg 300w, https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1-768x542.jpg 768w, https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1-1536x1084.jpg 1536w, https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1-600x423.jpg 600w, https:\/\/d3.harvard.edu\/platform-digit\/wp-content\/uploads\/sites\/2\/2022\/11\/IAP-price-increase-1.jpg 1600w\" sizes=\"auto, (max-width: 779px) 100vw, 779px\" \/><\/a><figcaption>Source: <a href=\"https:\/\/techcrunch.com\/2021\/04\/26\/apples-app-tracking-transparency-feature-has-arrived-heres-what-you-need-to-know\/\">TechCrunch<\/a><\/figcaption><\/figure>\n\n\n\n<p>While Apple\u2019s public battles with platforms such as Epic Games and Spotify had shone the spotlight on potentially anti-competitive practices, ProtonMail\u2019s highlighted a different matter: whether App Store commissions might actually undermine Apple\u2019s stated commitment to user privacy and data security. In 2021, Apple had updated its policies to bar apps from using third-party cookies to track user activity across apps, heralding its commitment to user privacy.<a href=\"https:\/\/techcrunch.com\/2021\/04\/26\/apples-app-tracking-transparency-feature-has-arrived-heres-what-you-need-to-know\/\"> But data showed<\/a> that average In-App Purchase prices had risen nearly 40% in the last year as a result. <\/p>\n\n\n\n<p><strong>Are Competition and Privacy<\/strong> <strong>Linked<\/strong>?<\/p>\n\n\n\n<p>Yen believed that the privacy and anti-trust issues were inextricably linked. Privacy-based businesses needed subscription-based business models to be profitable. Moreover, any mobile software solution had to be on the App Store, or else, \u201c<a href=\"https:\/\/www.nytimes.com\/2020\/07\/28\/technology\/apple-app-store-airbnb-classpass.html\">you\u2019re not online<\/a>.\u201d But subscription-based businesses were charged 30% commissions by Google and Apple, which in Yen\u2019s view made it \u201cimpossible\u201d to compete with ad-based businesses. In essence, Google and Apple\u2019s commissions were subsidizing ad-based businesses, and denying consumers the choice of privacy-based business models. <a href=\"https:\/\/qz.com\/why-proton-is-lobbying-against-apple-and-google-s-app-s-1849348459\">Said Yen<\/a>: \u201c[I]f you don\u2019t like Facebook\u2019s privacy practices\u2026 [y]our alternative is TikTok, which is not any better.\u201d Thus, increasing competition on the App Store and Play Store was critical to facilitating privacy: \u201c<a href=\"https:\/\/qz.com\/why-proton-is-lobbying-against-apple-and-google-s-app-s-1849348459\">if we solve the competition piece, we get privacy for free<\/a>.\u201d <\/p>\n\n\n\n<p>For its part, <a href=\"https:\/\/www.axios.com\/2021\/07\/22\/proton-swiss-privacy-app-us-antitrust\">Apple argued<\/a> that its behavior was anything but anticompetitive, noting that it accounted for only 60 of the 1.7m apps on the App Store and that 85% of apps didn\u2019t pay a commission, including an exemption for books, video and music apps.
